Legal notices # Breach of contract legal notice through a notary in Dubai A breach of contract legal notice tells the other party that they have not done what the contract requires, and gives them a last chance to perform. Under the UAE Civil Transactions Law, notice usually comes before a claim: a party that wants the court to order performance or to cancel the contract does so after giving notice to the party in default, and compensation is generally not due until the debtor has been formally put in default. Before you go ## What to bring * Your original Emirates ID or passport. * The signed contract, and any amendments. * Invoices, delivery notes, payment records or messages that show the breach. * The other party's name and the address the contract gives for notices. * For a company: the trade licence and proof that you may sign for it. A notice attested by a notary public records what you asked for and when. * In a two-sided contract, if one party does not perform when due, the other may ask the court for performance or rescission after giving notice (Article 234). * Compensation is not due until the debtor has been formally put in default, unless the law or the contract says otherwise (Article 337). * Even a contract that ends automatically on breach still needs notice, unless the parties expressly agreed to waive it (Article 235). * The law does not fix the form of the notice. A notice attested by a notary public is strong proof of what was sent. * For a fixed sum of money, a notice for payment of at least five days comes before a payment order (Civil Procedure Code, Article 144). ## When notice is not needed Article 338 lists cases where notice to the debtor is not required, including when performance has become impossible or pointless because of the debtor's own act, and when the debtor has declared in writing that they will not perform. A lawyer can tell you whether your case is one of them; a notice is rarely a wasted step. It names the contract, the obligation not performed, what must now be done and the deadline. 3. **You approve the wording** Nothing is signed until you are satisfied. 4. **Sign before the notary public** Our in-house notary public checks your ID and attests the notice. 5. **Serve it on the other party** At the address the contract gives for notices. 6. **Keep the proof** The notice and proof of service go with any later claim. The wording ## What the notice should say Breach of contract notice 1. The contract, its date and the parties. 2. The obligation that was not performed, with the clause number. 3. What the other party must do now, and a clear deadline. 4. For performance or rescission of a two-sided contract, the law says the claim follows notice to the party in default. Compensation is generally not due until the debtor has been formally put in default. There are exceptions in Article 338. ### How long should the deadline in the notice be? The law does not set one for a general contract. Use the period the contract gives; if it gives none, choose a fair time to perform. For a fixed debt, a notice for payment gives at least five days before a payment order. ### Can I send the notice by email? The Civil Transactions Law does not fix the form. A notice attested by a notary public is harder to dispute than an email. ### Does the notice have to be in Arabic?
