# Eviction notice through a notary public in Dubai

An eviction notice through a notary public is how a Dubai landlord tells a tenant, in a form the Rental Dispute Centre accepts, that the property must be handed back at the end of the lease. Dubai tenancy law allows eviction on expiry for four reasons only, and the landlord must give at least 12 months' notice, served through a notary public or by registered mail.

## What to bring

* Your original Emirates ID or passport.
* The title deed, and the tenancy contract with its Ejari registration.
* The tenant's full name and contact details as written in the contract.
* For own use: proof of the relationship if the property is for a first-degree relative.
* For renovation: the Dubai Municipality technical report.
* If you act for the owner: the power of attorney that lets you do so.

Step by step

## The four reasons for eviction at the end of the lease

Under Article 25(2) of Law No. 26 of 2007, as amended by Law No. 33 of 2008, the landlord may ask for eviction when the lease expires only if:

### Demolition and rebuilding

The owner wants to demolish and rebuild, or add new structures that would stop the tenant using the property, with the required permits.

### Renovation

The property needs restoration or full maintenance that cannot be done with the tenant inside, confirmed by a Dubai Municipality technical report.

### Own use

The owner wants the property for their own use or for a first-degree relative, and can show they own no other suitable property.

### Sale

The owner wishes to sell the property.

If the landlord takes the property back for own use and wins the case, the law says it may not be let to someone else for at least two years for a home, or three years for other property.

## How the eviction notice works, step by step

1. **Send us the tenancy contract and title deed** We check the names, the unit and the Ejari details.
2. **Choose the reason** The notice must name one of the four reasons above.
3. **We draft the notice** In Arabic, with an English copy. It gives the reason and the eviction date, at least 12 months after the tenant receives it.
4. **Sign before the notary public** Our in-house notary public checks your ID and attests the notice.
5. **Serve the notice on the tenant** It goes to the address, email and phone number given in the tenancy contract.
6. **Keep the proof** The notice and the proof of service are what the Rental Dispute Centre asks for if the tenant does not leave.

## The 12 month count

The 12 months run to the eviction date you state, and the tenant must receive the notice at least that long before it. Serve the notice early enough; a notice that reaches the tenant late does not meet the rule. The 90 day notice for changing the rent or terms on renewal is a different notice, not an eviction notice.

### Does an eviction notice in Dubai have to be notarised?

The law allows two routes for this notice: through a notary public or by registered mail. A notice attested by a notary public records exactly what was sent and when.

### Can a landlord evict a tenant before the lease ends?

Only for the reasons in Article 25(1), such as unpaid rent after a 30 day notice, unauthorised subletting or illegal use. Ending a lease early for a sale or own use is not one of them.

### What if the tenant refuses to leave after 12 months?

The landlord can file an eviction case at the Rental Dispute Centre, with the notice and the proof of how it was served.

### Can the owner sell the property and still evict the tenant?

Sale is one of the four reasons, with the same 12 month notice through a notary public or registered mail.
